Terms of Service
These terms govern your use of Splitt as a merchant. Plain-English summaries appear throughout, but the full text is what applies.

1. Who we are
Splitt ("Splitt", "we", "us") operates www.splitt.com.au, a service that lets a group of customers pay for a single purchase in shares ("the Service"). These terms are an agreement between Splitt and the business that creates a merchant account ("you", "the merchant"). By creating an account or using the Service you agree to these terms.
2. What the Service does
Splitt creates group payment pages for your orders. Each member of a group pays their own share through our payment processor, Stripe. When every share is paid within the payment window, the order completes and the proceeds (minus our fees) are settled to you. If the group does not finish paying in time, every paid share is automatically refunded in full and you receive nothing for that order.
Splitt is a payment facilitation service. We are not a bank, we do not provide credit, and we do not hold your funds — payments are processed and settled by Stripe Payments Australia Pty Ltd under their own terms, which you also agree to when connecting payouts.
3. Your account
- You must provide accurate business details and keep them current.
- You must complete Stripe's identity and payout onboarding before taking orders.
- You are responsible for activity on your account and for keeping your sign-in email and API keys secure.
4. Fees
Splitt charges a fee on completed orders only. There are no monthly fees, setup fees, or fees on refunded or expired orders. The fee is deducted per share before settlement:
- Base rate: 4.0% of each share paid by card or digital wallet (including Apple Pay and Google Pay).
- Buy-now-pay-later:6.25% of each share paid via a buy-now-pay-later method (Afterpay, Klarna or Zip), reflecting the materially higher processing costs of those methods. Your customers always pay exactly their share — this fee is never added to the customer's payment.
Founding merchants keep their base rate for the life of their account. We may otherwise change fees with at least 30 days' written notice; changes apply only to orders created after the notice period ends.
5. Payouts
Completed orders settle to your connected Stripe account automatically, and Stripe pays out to your nominated bank account on your Stripe payout schedule. Payout timing is controlled by Stripe, not Splitt.
6. Orders, refunds and cancellations
- Orders are all-or-nothing: they complete only when every share is paid within the payment window you chose.
- If the window closes with unpaid shares, all paid shares are refunded in full automatically. Refunds typically reach customers within 5–10 business days.
- You may cancel an open order at any time from your dashboard; paid shares are refunded in full.
- Refunds of completed orders (e.g. under your own cancellation policy), and any disputes or chargebacks on your orders, are your responsibility. Chargeback amounts and associated processor costs may be deducted from your settlements.
7. Your obligations
- Describe orders accurately and fulfil completed orders promptly — a completed order is a binding sale by you to the group.
- Comply with all applicable laws, including the Australian Consumer Law.
- Only sell goods and services permitted under Stripe's restricted business terms.
- Do not use the Service for anything unlawful, deceptive or fraudulent.
8. Your customers
The sale contract for the underlying goods or services is between you and your customers. Splitt facilitates the payment only. You are responsible for customer service relating to what you sell; we handle questions about the payment flow itself.
9. Intellectual property
We own the Service and everything in it other than your content. You grant us a licence to display the business name, logo and order details you upload, solely to operate the Service.
10. Privacy and data
Our Privacy Policy explains what we collect and why. You are responsible for having the right to share any customer information you pass to us.
11. Service availability
We aim for high availability but the Service is provided "as is" and we do not guarantee it will be uninterrupted or error-free. Nothing in these terms excludes guarantees that cannot be excluded under the Australian Consumer Law.
12. Liability
To the extent permitted by law, our total liability to you in any 12-month period is capped at the fees you paid us in the 3 months before the event giving rise to the claim, and neither party is liable for indirect or consequential loss. This cap does not apply to liability that cannot be limited by law.
13. Suspension and termination
You can close your account at any time; open orders are cancelled and refunded. We may suspend or terminate accounts that break these terms, create fraud or chargeback risk, or that Stripe requires us to suspend. Completed, fulfilled orders are settled normally on termination.
14. Changes to these terms
We may update these terms from time to time. Material changes will be notified to your account email at least 30 days before they take effect. Continued use after that date is acceptance.
15. Governing law
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
